Public meeting to discuss modification of wastewater discharge permit for We Energies generating station in Oak Creek

The Wisconsin Department of Natural Resources (DNR) will host a virtual public informational hearing to share information and take public comments on a proposed modification to the Wisconsin Pollutant Discharge Elimination System permit for the We Energies Elm Road Generating Station in Oak Creek to authorize use of a new wastewater treatment system.
The meeting will take place online via Zoom at 5 p.m. Monday, Nov. 20.
To comply with recent federal regulations, the We Energies Elm Road Generating Station has installed advanced treatment for wastewater from the plant’s flue gas desulfurization system, which is an air scrubber used to remove sulfur dioxide from air emissions. Once operating, this system will provide enhanced removal of contaminants including mercury, arsenic, selenium and nitrate/nitrite before discharge to Lake Michigan.
To monitor compliance with the new federal regulations, on Sept. 12, the DNR proposed to modify the facility’s existing Wisconsin Pollutant Discharge Elimination System permit to establish a dedicated sampling point for treated flue gas desulfurization wastewater. This proposed permit action does not increase existing limitations for mercury, arsenic or any other pollutants at the final outfall.
The hearing will include an informational presentation and the opportunity to provide comments or ask clarifying questions of DNR staff related to the proposed permit modification.

The DNR is seeking public comment on revised water condition lists for 2024, including the draft Impaired Waters List. Every two years, the Clean Water Act requires states to publish a list of all waters not meeting water quality standards and an overall report on surface water quality status of all waters in the state. The department is seeking comments and will provide more information at this public meeting.

Waterway General Permit Reissuances

The DNR is planning to reissue several general permits for activities in navigable waterways, including small scale dredging, dredging to remove plant and animal deposits, riparian navigational dredging and ponds. Key eligibility criteria and standards are not proposed to be changed. The public is invited to attend this public hearing to share comments on the proposed permit reissuances. The Wisconsin Department of Administration (DOA), in partnership with the DNR, is undertaking an evaluation of regulatory requirements associated with phosphorus surface water quality standards and economic impacts of the standards to municipal and industrial wastewater treatment facilities and the communities that rely upon them.
The evaluation is required under state statute prior to seeking an extension of the phosphorus multi-discharger variance (MDV) beyond the current term of approval (2017 – 2027). More information about the evaluation, including an informational document download, is available at https://doa.wi.gov/Pages/StatewideMDV.aspx. Public listening sessions are scheduled for mid-November in Madison (with virtual option) and Stevens Point (in-person only).
At the listening sessions, DOA & DNR staff will provide a short presentation of currently available information regarding the MDV. Water quality stakeholders and members of the public are encouraged to provide verbal comments at the meetings.
