We Energies-Oak Creek Power Plant, located at 11060 S Chicago Rd, Oak Creek, Milwaukee County, Wisconsin, FID 241007690, submitted to the Department of Natural Resources (DNR) a permit application, including plans and specifications for revision of 24100769A-P37 for operation of a Electric Power Generation facility; and the construction and operation of: five simple cycle combustion turbine electric generating units (CTGs) with a total electric generating capacity of approximately 1,200 MW; a 2.0 billion standard cubic foot Liquified Natural Gas (LNG) storage facility; and other equipment required to support this new generation. This project will also increase the use of natural gas in the Elm Road Generating Station Units 1 and 2 to the full rated capacity of these units.

This is a joint public hearing on permanent rules DG-03-23 and DG-04-23. DG-03-23 affects ch. NR 812 and is related to updating, correcting and clarifying existing code requirements and adding requirements for new pump installations and water treatment and other specified code requirements affecting small businesses. DG-04-23 affects ch. NR 146 and is related to water well driller, heat exchange driller, pump installer licensing and registration; and drilling rig operator registration affecting small business.
The public has the opportunity to testify at the hearing. Pre-registration is strongly encouraged if you plan to provide spoken comments during the hearing. To pre-register, either use the Zoom link before the day of the hearing or download and complete the fillable hearing appearance form and email it to Robert.Gundrum@wisconsin.gov.
Comments on the proposed rules must be received on or before April 22, 2025. Written comments may be submitted by U.S. mail, email or through the Internet and will have the same weight and effect as oral statements presented at the public hearing. NOTICE IS HEREBY GIVEN that the State of Wisconsin Division of Hearings and Appeals will hold a contested case hearing on the above-captioned matter pursuant to Wis. Stat. § 227.44, Wis. Admin. Code § NR 2.13 and Wis. Admin. Code § HA 1.12 at the Green Lake County Government Center, Second Floor – Courtroom 2, 571 County Road A, Green Lake, Wisconsin on April 29, 2025 and continuing if necessary on April 30 and May 1, 2025, commencing at 9 a.m. each day. Members of the public desiring to participate in this hearing pursuant to Wis. Admin. Code § NR 2.08 will be allowed the opportunity to do so at the end of the presentation of evidence. Such interested persons must enter an appearance either prior to or at the commencement of the contested case hearing. Information about the hearing may be found at the DNR website and can also be requested from Susan Burns at 608-266-3865. Please monitor the DNR website for updates.
The hearing is a Class 2 contested case pursuant to Wis. Stat. § 227.01(3)(a), and the provisions of Wis. Stat. ch. 227 will apply. The procedures relating to contested cases set forth in Wis. Admin. Code ch. NR 2 will be followed. Said procedures will closely resemble those that are normally followed at a trial in State circuit court. All parties are advised that they have the right to seek the aid and assistance of legal counsel and to be represented by legal counsel at the contested case hearing.
