Prehearing Conference On Contested Case Hearing To Dredge Materials From Lake Beulah in the town of East Troy

On Aug. 15, 2023, the Wisconsin Department of Natural Resources (Department) issued Permit #IP-SE-2022-65-00919 to Susan Guthart to dredge materials from Lake Beulah located in the SW 1/4, NE 1/4., Section 08, Township 04, Range 18E, in the Town of East Troy, Walworth County. On or about Sept. 14, 2023, RE3 Legal, LLC (Petitioner) filed for a Petition for a Contested Case Hearing with the department pursuant to Wis. Stat. § 30.209.
By letter dated Oct. 16, 2023, the department granted the Petitioner’s request for a contested case hearing on the following issues: (1) whether the department complied with the procedural requirements specified in Wis. Stat. §§ 30.208(3)-(5) prior to issuing the dredging permit; and (2) whether the issuance of the dredging permit was consistent with the public interest in Lake Beulah and therefore met the standard in Wis. Stat. § 30.20(2)(c).
On Nov. 7, 2023, the Division of Hearings and Appeals received, for filing, an original request for a hearing from the department. The parties have conferred and agreed to a date for a prehearing conference and dates for the contested case hearing.
NOTICE IS HEREBY GIVEN that the State of Wisconsin Division of Hearings and Appeals will hold a telephonic prehearing conference on the above-captioned matter pursuant to Wis. Stat. § 227.46(1) and Wis. Admin. Pre-hearing conference on permit to allow city of delafield to place pier on Nagawicka Lake

On April 24, 2023, the Department of Natural Resources (DNR) approved an application and Permit IP-SE-2022-68-02139 to allow the City of Delafield to place a pier on Nagawicka Lake located in the SW 1/4, SW 1/4, Section 17, Township 07, Range 18E, City of Delafield, Waukesha County. The Board of Directors of the Waukesha County Environmental Action League (WEAL) and the Defenders of St. Johns Bay, an unincorporated association, Scott Botcher, Jim Nelson, Mary Nelson, Tim Holt, Kim Holt, Chris Pitzo, Suzie Pitzo, C. Michael Hausman, Jane Hausman, and Julie Hollingsworth (collectively “the petitioners”) filed separate petitions for a contested case hearing with the DNR to review the decision to issue the permit to the City of Delafield pursuant to Wis. Stat. §§ 30.209 and 227.42. By letter dated June 21, 2023, the DNR granted a contested case hearing and limited the hearing to the following issues:
- Whether Permit Application IP-SE-2022-68-02139 met the standards set forth in Wis. Stat. § 30.12(3m), or whether any additional permit conditions are necessary to protect the public interest in Nagawicka Lake.
- Whether the proposed pier and boat slips constitute a reasonable use of the riparian property.
- Whether the City of Delafield has granted any riparian right in land to St. John’s Northwestern Academy, contrary to Wis. Stat. § 30.133.
On Nov. 7, 2023, the DNR submitted a request for hearing to the Division of Hearings and Appeals.

This is a preliminary public hearing on Statement of Scope SS 075-23 (Board Order RR-14-23), which affects chs. NR 700, 708, 714, 722, 724, 725, 726, 727, and 749, Wis. Adm. Code, and is related to definitions, notifications, fees, agreements, reports, and procedures for interim action and remedial action continuing obligations for environmental contamination.
This hearing will also include the preliminary public hearing on Statement of Scope SS 074-23 (Board Order RR-15-23), which affects chs. NR 700, 720, and 722, Wis. Adm. Code, and is related to definitions, land use classifications, procedures for identifying environmental standards for soil, and soil cleanup standards used to investigate and remediate environmental contamination.

On Dec. 30, 2022, 1989 Holdings, LLC filed an application, Application IP-SE-2022-68-05007, with the Wisconsin Department of Natural Resources (DNR) for a permit to construct two piers and 20 boat slips on Pewaukee Lake in the City of Pewaukee. The DNR denied the application by decision dated May 12, 2023.
On June 12, 2023, 1989 Holdings, LLC filed a petition for a contested case hearing with the DNR to review the denial pursuant to Wis. Stat. §§ 30.209 and 227.42 and Wis. Admin. Code § NR 2.05. By letter dated July 12, 2023, the DNR granted the request for a contested case hearing, which the DNR limited to the following issues: (1) whether the proposed piers and boat slips met the public interest standard set forth in Wis. Stat. § 30.12(3m)(c); and (2) whether the proposed piers and boat slips constituted a reasonable use of the riparian property.
On Aug. 10, 2023, the Division of Hearings and Appeals received, for filing, an original request for hearing from the DNR. The parties have conferred and agreed to a date for a prehearing conference and dates for the contested case hearing.
NOTICE IS HEREBY GIVEN that the State of Wisconsin Division of Hearings and Appeals will hold a contested case hearing on the above-captioned matter pursuant to Wis. Stat. § 227.44, Wis. Admin. Code § NR 2.13 and Wis. Admin. Code § HA 1.12 at the Lee Sherman Dreyfus State Office Building, Room 151, 141 NW Barstow St., Waukesha, Wisconsin on Dec. 18, 2023, and continuing if necessary on Dec. 19 and 20, 2023, commencing at 9 a.m. each day.
Members of the public desiring to participate in this hearing pursuant to Wis. Admin. Code § NR 2.08 will be allowed the opportunity to do so at the end of the presentation of evidence. NOTICE IS HEREBY GIVEN, pursuant to section NR 514.045(3), Wis. Adm. Code, that the Department of Natural Resources (DNR) has determined the plan of operation modification report submitted by Alliant Energy for the initial permitting of the Columbia Energy Center Dry Ash Disposal Facility (License #3025) is complete. The landfill is a coal combustion residual (CCR) landfill currently operating under a plan of operation approval issued by the DNR dated June 30, 1983. In accordance with the procedures of s. NR 514.045, Wis. Adm. Code, the plan of operation modification report is a proposed update to the approved plan of operation to comply with the applicable requirements under chs. NR 500 through 520, Wis. Adm. Code for CCR landfills. In 2022, sections of chs. NR 500 through NR 520, Wis. Adm. Code were updated for CCR landfills to meet federal CCR rule requirements. The landfill is located in Section 27, T12N, R9W, Town of Pacific, Columbia County, Wisconsin.
A virtual meeting to receive oral comments for initial permitting of the CCR landfill will start at 3 p.m. on Dec. 18, 2023, via Zoom.
The DNR will accept written comments by any person concerning the proposed plan of operation modification report for initial permitting of the CCR landfill that are received within 60 days after the date of publication of this notice to DNR engineer Ann Bekta at Ann.Bekta@wisconsin.gov or 2514 Morse Street, Janesville, WI 53545.

Agenda items include updates and discussion on recent and anticipated PFAS actions, research on PFAS in Wisconsin and updates from working groups.
This is a working meeting of the EAG. While the public is invited to attend, there may not be opportunities to engage in the discussion.
