Notifying the Air Program About Administrative Facility Changes

Facilities holding air permits must notify the Air Program about changes to the facility name, ownership, parent company or responsible official. Other changes, such as contact names, email addresses or phone numbers, can also be submitted through the process described below or made directly by the facility through the DNR Switchboard. Up to date contact information is essential for DNR to keep facilities informed about due dates of reports or applications, potential changes to air pollution laws and regulations that may affect them.

Note: There is a different process to follow for closing down a facility with air permits.

Changes To Responsible Official

A change in responsible official can only be made by the DNR. The designated responsible official must meet the role definition in NR 400.02(136), Wis. Adm. Code. He or she should be someone in charge of principle business function and have authority to shut down the operation in case of an emergency. Send an email or a letter with the information below as soon as possible after the date of the change. The responsible official needs a WAMS ID to use DNR e-signature options.   • Facility Identification (FID) Number
  • Facility name
  • Facility location address
  • Old responsible official name
  • New responsible official information, including:
    • Name
    • Work title
    • Mailing address
    • Phone number
    • Email address
    • WAMS ID (if available)

Changes To Ownership, Parent Corporation Or Facility Name

"Facility name" is the legal name listed in the air permit. The Air Program does not list "owner" or "parent company" information in an air permit. For changes in ownership or parent company and/or changes to the facility's legal name, send an email or a letter including the following information on or as soon as possible after the date of the change. Facilities should also provide the Air Program with a written agreement containing a specific date for transfer of permit responsibility, coverage and liability between the current and new permittee, pursuant to s. NR 407.11 (1)(d), Wis. Adm. Code. Note that the responsible official should be the sender of this notification email/letter or should be copied in the email/letter.

For facilities covered under Registration Permits or General Permits, the Air Program will issue a new permit coverage approval letter to reflect the facility name changes.

For facilities holding source-specific operation permits, the facility name and responsible official are listed in the operation permit and will be updated at the time of renewal. If the operation permit does not expire or if the source wishes to update the name and responsible official sooner than at renewal time, the facility can apply for an Administrative Permit Revision by filling out permit application Form 4530-100 and submitting the application as instructed in the form. Facilities should also provide the Air Program with a written agreement containing a specific date for transfer of permit responsibility, coverage and liability between the current and new permittee, pursuant to s. NR 407.11 (1)(d), Wis. Adm. Code.

There are no fees associated with administrative permit revisions.
