PUBLIC NOTICE OF INFORMATIONAL HEARING FOR THE NE LAKESHORE TOTAL MAXIMUM DAILY LOAD STUDY

The Wisconsin Department of Natural Resources is conducting a public informational hearing to provide an overview of the final draft report and receive comments on the “Northeast Lakeshore TMDL: Total Maximum Daily Loads for Total Phosphorus and Total Suspended Solids” (TMDL Study).

The TMDL Study spans a portion of the Lake Michigan watershed from just south of Sturgeon Bay to Port Washington and reaches west towards Lake Winnebago covering 1,964 square miles. The TMDL report summarizes the multi-year effort which provides a blueprint for improving water quality in the tributaries, streams, rivers, and lakes within the TMDL Study area.

A copy of the public hearing version of the TMDL Study will be available for review on the website beginning July 28, 2023.

The public hearing version of the TMDL Study incorporates input and comments received during the previous review periods and the March 2023 listening session and comment period. The public informational hearing will include a presentation outlining the clarifying text added to the TMDL report which discusses climate change considerations, clarifies margin of safety assumptions, discusses dissolved reactive phosphorus, and outlines implementation planning and monitoring considerations.

The public informational hearing will be held via Zoom and will be recorded.   

Pre-registration is required at this link.

Written comments will be accepted through Sept. 1, 2023. Verbal comments, received during the public hearing, and written comments received prior to the close of the comment period will be considered prior to making a final approval and submittal of the TMDL Study to U.S. EPA. Written and verbal comments carry the same weight. A summary with response to comments shall be included in the final TMDL Study report.

NOTICE IS HEREBY GIVEN that the contested hearing on the above-captioned matter has been rescheduled. The State of Wisconsin Division of Hearings and Appeals will hold the contested case hearing pursuant to Wis. Stat. § 227.44, Wis. Admin. Code § NR 2.13, and Wis. Admin. Code § HA 1.12 at the Milwaukee State Office Building, Room 518, 819 N. 6th Street., Milwaukee, Wisconsin on Aug. 2, Aug. 3, Aug. 4, and Aug. 8, 2023, commencing at 8:30 a.m. each day.

Members of the public desiring to participate in this hearing pursuant to Wis. Admin. Code § NR 2.08 will be allowed the opportunity to do so at the end of the presentation of evidence. Such interested persons should enter an appearance either prior to or at the commencement of the contested case hearing. Information about the hearing may be found at the DNR website and can also be requested from Susan Burns at 608-266-3865. Please monitor the DNR website for updates.


The hearing is a Class 1 contested case pursuant to Wis. Stat. § 227.01(3)(a), and the provisions of Wis. Stat. ch. 227 will apply. The procedures relating to contested cases set forth in Wis. Admin. Code ch. NR 2 will be followed. Said procedures will closely resemble those that are normally followed at a trial in State circuit court. All parties are advised that they have the right to seek the aid and assistance of legal counsel and to be represented by legal counsel at the contested case hearing.


The issues for hearing are as follows. On Aug. 29, 2022, David R. Krause filed an After-the-Fact Permit Application with the Wisconsin Department of Natural Resources (DNR) under Wis. Stat. §§ 30.12 and 30.28 for the placement of a steel seawall and fill material along the shoreline and below the ordinary high water mark (OHWM) of Lake Michigan located at 4696 Bark Road in the NE 1/4, SE 1/4, Sec. 16, T. 28N, R. 27E, Town of Sevastopol, Door County (Permit Application IP-NE-2022-15-03206). DNR denied the application by order dated Nov. 22, 2022.


On Dec. 21, 2022, Mr. Krause filed a petition for a contested case hearing with the DNR to review the denial pursuant to Wis. Stat. §§ 30.209 and 227.42 and Wis. Admin. Code § NR 2.05. By letter dated Jan. 20, 2023, the DNR granted the request for a contested case hearing, which the DNR limited to the following issue: whether the DNR properly determined that After-the-Fact Permit Application IP-NE-2022-15-03206 failed to meet the standards of Wis. Stat. § 30.12.


On March 16, 2023, the Division of Hearings and Appeals received, for filing, an original request for hearing from the DNR. The request is for a consolidated hearing on two issues: (1) Mr. Krause’s request for administrative review of DNR’s denial of the After-the-Fact Permit Application; and (2) a request by DNR for nuisance abatement under Wis. Stat. § 30.03.


The permit application and other information relating to this matter are on file and may be inspected and copied at the offices of the Department of Natural Resources, 101 South Webster Street, Madison, Wisconsin, between the hours of 9 a.m. and 3:30 p.m., Monday through Friday, holidays excepted. Contested Case Hearing Regarding Coverage Granted to the Three Lakes School District under Wetland General Permit WDNR-GP04-2018 for Wetland Fill

In July 2018 the DNR granted coverage to the School District under Wetland General Permit WDNR-GP04-2018. Permission was granted for the School District to impact .207 acres of wet meadow wetland to develop a shooting range located in the NE 1/4, SE 1/4, Sec. 17, T. 38, R. 10E, Town of Sugar Camp, Oneida County. On Jan. 27, 2023, the Petitioners filed a Petition for a Contested Case Hearing with the DNR to review the decision to grant coverage under the general wetland permit pursuant to Wis. Stat. §§ 227.42 and 281.36.

By letter dated Feb. 16, 2023, the DNR granted the request for contested case hearing but limited the hearing to the following issue:
Whether the proposed project meets the eligibility criteria and conditions of WDNR-GP4-2018.

A prehearing conference was held on April 25, 2023 and a scheduling order was entered setting the contested case hearing commencing on July 31, 2023.

The issue(s) for hearing were clarified to identify the five eligibility criteria under the general permit that the Petitioners are contesting have not been met consistent with Wis. Stat. § 281.36(3g), including the following:
(a) Project discharge does not affect more than 10,000 square feet (0.23 acre) of wetland as part of a single and complete project;
(b) The proposed project cannot avoid wetland impacts;
(c) The proposed project minimizes wetland impacts to the greatest extent practicable;
(d) The discharge will cause only minimal adverse environmental effects; and
(e) The project will be constructed in a manner that will maintain wetland hydrology in the remaining wetland complex.

NOTICE IS HEREBY GIVEN that the State of Wisconsin Division of Hearings and Appeals will hold a contested case hearing in the above captioned case, pursuant to Wis. Stat. § 281.36(3q), Wis. Stat. § 227.44, Wis. Stat. § 227.46, and Wis. Admin. Code § Chapter NR 2, from July 31, 2023 through Aug. 2, 2023, at the Oneida County Courthouse, 1 S. Oneida Avenue, Committee Room #2, 2nd Floor, in Rhinelander, Wisconsin.

Please note that, on Aug. 2, 2023, the contested case hearing will begin at 9 a.m., but will recess at 3 p.m. It is expected that testimony will be heard at the contested case hearing. The contested case hearing will be a Class 1 contested case, pursuant to Wis. Stat. § 227.01(3)(a). The procedures set forth in Wis. Stat. § 227.46(1) and Wis. Admin. Code § Chapter NR 2 will be followed and those procedures will closely resemble those which are normally followed at a trial in State Circuit Court.

Members of the public will be provided an opportunity to present comments at the outset of the hearing consistent with Wis. Admin. Code § NR 2.08(2). Time limits for submission of public comments may be imposed at the discretion of the administrative law judge.
