Details 

The Department of Natural Resources will hold a public hearing and informational webinar to gather input on which topics related to surface water quality standards should be top priorities for work over the next three years. This is part of the DNR’s Triennial Standards Review process to determine how the DNR should focus its available resources to ensure the health of Wisconsin lakes, rivers and streams.

At this meeting, the DNR will provide the department’s draft list of priority topics, describe each topic and take comments and questions.

The public has the opportunity to testify at the hearing. Registration will take place when joining the meeting via the Zoom link.  Any attendees phoning in may verbally notify the Hearing Officer that they would like to make a statement, and the Hearing Officer will verbally ask for the information on the Hearing Appearance form.

Comments must be received on or before July 26, 2024. Written comments may be submitted by email or U.S. mail and will have the same weight and effect as oral statements presented at the public hearing. Written comments and questions on the Triennial Standards Review should be submitted to:

The DNR and the RAC will discuss rule changes relating to continuing obligations under the Scope Statement for Board Order RR-14-23, which proposes developing administrative rules that affect chapters NR 700, 708, 714, 722, 724, 725, 726, 727 and 749 related to definitions, notifications, fees, agreements, reports and procedures for interim action and remedial action continuing obligations for environmental contamination.

NOTICE OF PREHEARING CONFERENCE

On Nov. 17, 2023, Aggregate Producers of Wisconsin, Inc., Milestone Materials, Michels Road & Stone, Inc., Payne & Dolan, Inc., Forever Sandfill and Limestone, Inc., County Materials Corporation and MCC, Inc. (collectively “Petitioners”), by their attorneys Husch Blackwell, LLP, filed a Petition for a Contested Case Hearing with the Wisconsin Department of Natural Resources (“DNR”) seeking review of modified provisions of the WPDES Mineral (Nonmetallic) Mining General Permit No. WI-0046515-07-1, effective Oct. 1, 2023 (the “Permit”). By letter dated March 11, 2024, the DNR granted the request for a contested case hearing pursuant to Wis. Stat. § 283.63 and limited the hearing to the following issue:

Are the modified monitoring requirements in Section 4.2.3.1 and related provisions in Sections 4.2.3.1.3.4, 4.5 and 4.62 necessary or reasonable for non-industrial nonmetallic mining facilities that produce crushed stone and other nonmetallic mineral products such as sand and gravel used in transportation and other construction projects?

On June 7, 2024, the DNR submitted to the Division of Hearings and Appeals a request for hearing. The parties have agreed to a date for a prehearing conference.

NOTICE IS HEREBY GIVEN that the State of Wisconsin Division of Hearings and Appeals will hold a prehearing conference on the above-captioned matter pursuant to Wis. Stat. §§ 227.44 and 227.46(1), and Wis. Admin. Code §§ NR 2.08(5) and 2.12, at 10 a.m. on July 23, 2024, via Microsoft Teams. Interested persons may request an email invitation to the Teams Video Conference by contacting the Division of Hearings and Appeals at 608-266-7709. Alternatively, those interested in participating may participate by telephone by calling 608-571-2209 and entering meeting ID 869 231 803# 

Any person, organization or governmental unit wishing to become a party to this proceeding must attend the conference personally or by an authorized representative. The purpose of the prehearing conference will be to identify parties to the proceeding, simplify or clarify the issues which may be contested at the hearing, identify witnesses, discuss the exchange of exhibits, establish a discovery schedule, address any other matters as may aid in the disposition of the action, and schedule a date for the contested case hearing.  No testimony will be heard at the prehearing conference. However, a date may be selected for a contested case hearing. 

All parties are advised that they have the right to seek the aid and assistance of legal counsel and to be represented by legal counsel at the contested case hearing.

Contested Case Hearing Prehearing Conference – Denial Of After-The-Fact Permit Application By Keith and Colleen Mustain

On or about March 24, 2023, Keith and Colleen Mustain (Petitioners) filed an After-the-Fact Permit Application with the Wisconsin Department of Natural Resources (DNR) under Wis. Stat. § 281.36 for the placement of fill into wetlands on their property located at Government Lot 3, Section 32, Township 19 North, Range 16 East, Town of Oshkosh, Winnebago County (Permit Application IP-NE-2023-71-0090). DNR denied the application by order dated September 11, 2023.

On October 10, 2023, the Petitioners filed a petition for a contested case hearing with the DNR to review the denial pursuant to Wis. Stat. §§ 227.42 and 281.36 and Wis. Admin. Code ch. NR 2. By letter dated November 9, 2023, DNR granted the request for a contested case hearing, which DNR limited to the following issues: (1) whether DNR properly applied the requirements under Wis. Stat. § 281.36(3b) and (3m) to the Petitioners’ March 24, 2023 individual permit application; and (2) whether the proposed project represents the least environmentally damaging practicable alternative taking into consideration practicable alternatives that avoid wetland impacts and whether all practicable measures to minimize the adverse impacts to wetland functional values will be taken (Wis. Stat. § 281.36(3n)(c)1. & 2.).

On February 27, 2024, the Division of Hearings and Appeals received, for filing, an original request for hearing from the DNR.
