Details 
  1. In the initial scheduling order issued in this matter on Oct. 2, 2024, the matter was scheduled for a video hearing beginning on Aug. 5, 2025, and continuing through Aug. 8, 2025, as needed. The parties discussed that the ALJ may review whether the hearing should proceed by video conference or schedule the matter for an in-person hearing. Subsequently, the Petitioners requested that the matter be scheduled for an in-person hearing, raising concerns with technology for individual Petitioner’s testimony and public statements, asserting that their expert is local and expecting that materials, such as maps and concepts of groundwater flow, may be better explained in person. The Permittees and the Department raised concerns about the distance that an in-person hearing would require for their experts and witnesses.

  2. This matter shall proceed as a Class 1 hearing as scheduled beginning on Aug. 5, 2025, at 9 a.m. and continue through Aug. 8, 2025, as needed. The hearing shall take place via Microsoft Teams video conference. A Teams invitation has been sent by email to the parties, and it may be forwarded to witnesses.

  3. As an accommodation for the Petitioners, the first day of hearing, Aug. 5, 2025, shall be held in person at the Portage County Public Library, Stevens Point Branch, in the Pinery Room, 1001 Main Street, Stevens Point, Wisconsin 54481. This day of hearing shall also be available by video via Microsoft Teams for public observation. Witnesses testifying on the first day of hearing may appear either in person or by video. All other hearing days shall proceed by video only.

  4. Pursuant to Wis. Admin. Code § NR 2.08, any member of the public may participate in the hearing. Any person desiring to participate shall enter an appearance at the beginning of the hearing either prior to or at the commencement of the contested case hearing either in person or by video on Aug. 5, 2025.
