TDM Estate, LLC has filed an After-the-Fact Permit Application with the Wisconsin Department of Natural Resources (DNR) under Wis. Stat. §§ 30.12 and 30.208 for the placement of fill material and riprap below the ordinary high water mark (OHWM) of Lake Puckaway at its property located at NW1/4, SE1/4, Section 21, Township 15 North, Range 11 East in the Town of Mecan, Marquette County, Wisconsin (Permit Application IP-NE-2023-30-00989). DNR denied the application by order dated Oct. 3, 2023.

On Nov. 2, 2023, TDM Estate, LLC filed a petition for a contested case hearing with the DNR to review the denial pursuant to Wis. Stat. §§ 30.209 and 227.42 and Wis. Admin. Code ch. NR 2. By letter dated Dec. 4, 2024, DNR granted the request for a contested case hearing, which DNR limited to the following issues: (1) whether the proposed project to place fill material and riprap below the OHWM of Lake Puckaway was detrimental to the public interest and therefore failed to meet the standard in Wis. Stat. § 30.12(3m)(c)(2); (2) whether the riprap placed below the OHWM of Lake Puckaway met the exemption criteria in Wis. Stat. § 30.12(1g)(jm); and (3) whether a decision issuing the permit must be considered to be rendered pursuant to Wis. Stat. § 30.208(3)(f).

On Feb. 20, 2024, the Division of Hearings and Appeals received, for filing, an original request for hearing from the DNR. The request is for a consolidated hearing on two issues: (1) TDM Estate, LLC’s request for administrative review of DNR’s denial of the After-the-Fact Permit Application; and (2) a request by DNR for nuisance abatement under Wis. Stat. § 30.03.

NOTICE IS HEREBY GIVEN that the State of Wisconsin Division of Hearings and Appeals will hold a prehearing conference on the above-captioned matter pursuant to Wis. Stat. § 227.46(1) and Wis. Admin. Code §§ NR 2.08(5) and 2.12, via Microsoft Teams on May 16, 2024 at 10 a.m. To connect to the conference call, dial 608-571-2209 and then enter Meeting ID: 256-301-958# when prompted.

Any person, organization, or governmental unit wishing to become a party to this proceeding must attend the conference personally or by an authorized representative. On April 24, 2023, the Department of Natural Resources (DNR) approved an application and Permit IP-SE-2022-68-02139 to allow the City of Delafield to place a pier on Nagawicka Lake located in the SW 1/4, SW 1/4, Section 17, Township 07, Range 18E, City of Delafield, Waukesha County. The Board of Directors of the Waukesha County Environmental Action League (WEAL) and the Defenders of St. Johns Bay, an unincorporated association, Scott Botcher, Jim Nelson, Mary Nelson, Tim Holt, Kim Holt, Chris Pitzo, Suzie Pitzo, C. Michael Hausman, Jane Hausman, and Julie Hollingsworth (collectively “the petitioners”) filed separate petitions for a contested case hearing with the DNR to review the decision to issue the permit to the City of Delafield pursuant to Wis. Stat. §§ 30.209 and 227.42. By letter dated June 21, 2023, the DNR granted a contested case hearing and limited the hearing to the following issues:

  1. Whether Permit Application IP-SE-2022-68-02139 met the standards set forth in Wis. Stat. § 30.12(3m), or whether any additional permit conditions are necessary to protect the public interest in Nagawicka Lake.
  2. Whether the proposed pier and boat slips constitute a reasonable use of the riparian property.
  3. Whether the City of Delafield has granted any riparian right in land to St. John’s Northwestern Academy contrary to Wis. Stat. § 30.133.

On Nov. 7, 2023, the DNR submitted a request for hearing to the Division of Hearings and Appeals. A prehearing conference was conducted on Dec. 21, 2023 via remote video conferencing at which time the named parties were identified and certified and a hearing date scheduled.

NOTICE IS HEREBY GIVEN that the State of Wisconsin Division of Hearings and Appeals will conduct a contested case hearing in the above-captioned matter pursuant to Wis. Stat. §§ 227.44 - 227.46 and Wis. Admin. Code §§ NR 2.08 and NR 2.13, beginning on Monday, June 17, 2024 at 1 p.m. and continuing on Tuesday, June 18 through Friday, June 21, 2024, as needed, in Room 151 at the Lee Sherman Dreyfus State Office Building, 141 NW Barstow Street (west building entrance) in Waukesha, Wisconsin. Members of the public will be allowed to offer sworn comments on the record at the outset of the hearing on Monday, June 17, 2024 at 1 p.m. Public comments will be limited in time and limited in scope to the issues identified above.

On or about March 24, 2023, Keith and Colleen Mustain (Petitioners) filed an After-the-Fact Permit Application with the Wisconsin Department of Natural Resources (DNR) under Wis. Stat. § 281.36 for the placement of fill into wetlands on their property located at Government Lot 3, Section 32, Township 19 North, Range 16 East, Town of Oshkosh, Winnebago County (Permit Application IP-NE-2023-71-0090). DNR denied the application by order dated September 11, 2023.

On October 10, 2023, the Petitioners filed a petition for a contested case hearing with the DNR to review the denial pursuant to Wis. Stat. §§ 227.42 and 281.36 and Wis. Admin. Code ch. NR 2. By letter dated November 9, 2023, DNR granted the request for a contested case hearing, which DNR limited to the following issues: (1) whether DNR properly applied the requirements under Wis. Stat. § 281.36(3b) and (3m) to the Petitioners’ March 24, 2023 individual permit application; and (2) whether the proposed project represents the least environmentally damaging practicable alternative taking into consideration practicable alternatives that avoid wetland impacts and whether all practicable measures to minimize the adverse impacts to wetland functional values will be taken (Wis. Stat. § 281.36(3n)(c)1. & 2.).

On February 27, 2024, the Division of Hearings and Appeals received, for filing, an original request for hearing from the DNR.
